These Terms of Service ("Terms") govern your use of Azias Designs services. By purchasing or using our services, you agree to these Terms. Please read them carefully before engaging with us.

1. Services Provided

Azias Designs offers custom and graphic design services to clients. These services include, but are not limited to, thumbnails, marketing materials (such as business cards, flyers, posters) and social media graphics. All designs are created based on the details provided by you. We are committed to creating high-quality work tailored to your needs, but it is essential that you provide complete and accurate information to ensure the final product meets your expectations.

2. Payment Terms

Our standard payment policy requires full upfront payment for all design services unless otherwise agreed upon in writing. Upon receiving payment, we will begin work on your project. Accepted payment methods include debit/credit cards. In cases where we offer payment plans or partial payments, these will be discussed and confirmed prior to the commencement of work.

Please be aware that transaction fees may apply depending on the payment platform. If you request a cancellation or refund, please note that payment processing fees may not be refunded. All prices quoted are final and non-negotiable once payment is received unless otherwise agreed upon.

3. Delivery and Deadlines

The average delivery time for design work is 3 days from the receipt of all required information and materials from you. However, this timeline may vary depending on the complexity of the project, the availability of necessary information, and other factors. If you have an urgent requirement, we offer a rapid delivery option, which may adjust the timeline accordingly.

Delivery times are estimates and may be subject to delays, especially if we are waiting for additional information or approvals from you. Timely communication and providing the required materials promptly will help ensure a faster turnaround. If delays are caused by your failure to provide necessary details or feedback, the delivery time may be extended, and we will not be held responsible for any inconvenience caused by this delay.

4. Client Responsibilities

To ensure the best outcome for your design project, you must provide clear, complete, and accurate information about your vision, preferences, and any assets needed for the project. As the client, it is your responsibility to provide detailed briefs, design preferences, and any necessary assets, such as logos, images, or other materials.

You must also respond to feedback requests or revision suggestions in a timely manner and communicate any changes or additional requirements early in the process to avoid delays. We cannot proceed with a design if the necessary information or assets are not provided. If the designs do not meet your expectations due to incomplete or unclear instructions, this is not our responsibility.

5. Usage Rights and Ownership

Upon delivery and full payment for your design project, you will receive the right to use the design for personal or business purposes as outlined in our agreement. This includes use on websites, marketing materials, and social media accounts. However, you do not have the right to resell, redistribute, or give the design to third parties for their use. The design is intended exclusively for your personal or business use, and you cannot share it with others unless agreed upon in writing.

Designs remain the intellectual property of Azias Designs until full payment has been made. Once payment is complete, you are granted the rights to use the design as per the agreed terms.

6. Confidentiality

If you require confidentiality regarding any aspect of your project, we will be happy to agree to a Non-Disclosure Agreement (NDA). This agreement will ensure that any sensitive or proprietary information you provide remains confidential and is not disclosed to third parties. The NDA will outline the scope of confidentiality and what can and cannot be shared regarding your project.

7. Cancellations

You may cancel your order at any time before work has started. Once the design process has begun, cancellations are no longer possible. If you cancel your order before any work has started, you will be refunded the full amount, minus any processing fees that may have been incurred through payment platforms (these fees are non-refundable). If work has already started, we cannot offer a cancellation or refund.

We recommend discussing any concerns or changes with us early to avoid any misunderstandings or cancellation requests after the design process has commenced.

8. Liability and Post-Delivery Issues

Once the design is delivered and approved, Azias Designs is not responsible for any further revisions or changes unless the issue is due to a mistake on our part. If any issues arise post-delivery that were not caused by you, we will review the situation and decide whether it is appropriate to make corrections or adjustments.

Post-delivery revisions will be evaluated on a case-by-case basis. If the error is found to be due to a miscommunication or failure on our part, we will rectify it at no additional charge. If the issue arises from a client request or misunderstanding, additional charges may apply.

9. Revisions and Additional Fees

We offer free revisions as part of our design process. If, after the initial design, you would like to make changes, we will happily accommodate reasonable revisions. However, if the requested changes are extensive or go beyond the scope of the initial agreement, we may charge an additional fee for further revisions.

If the revisions are due to a lack of clarity or incomplete information provided initially, we reserve the right to charge additional fees for the time and resources required to make these changes.

10. Governing Law

These Terms will be governed by and construed in accordance with the laws of England. By using our services, you agree that any legal disputes arising from these Terms will be resolved in the courts of England, unless otherwise agreed upon in writing. If you are located outside England, you agree to submit to the jurisdiction of the courts in England.
